Rumor: 6.44-inch Xperia Z-like (Togari) and 5-inch ?One Sony? (Honami) coming in H2 2013


A new report indicates that Sony could launch two new flagship devices in the second half of the year, with the devices currently known as the Togari and Honami.

Naturally, this is just a rumor for now, so, as always in such cases, take everything that follows with a grain of salt.The Togari is said to sport a Full HD (1920 x 1080 resolution) 6.44-inch display and offer a design similar to the already launched Xperia Z. The handset (phablet if you will) would come with a very slim profile like the Xperia Z and Xperia Tablet Z products and will feature a back made from glass.

The Togari would be available ?at least? in white, and could ship as early as July in Sony?s home country, or right in time to take on the Galaxy Note 3. Or better said, right in time to beat the Galaxy Note 3 to market by a few months, Samsung?s upcoming high-end player in the big smartphone business ? of course, assuming that this new rumor is accurate. Coincidentally, the Xperia Z was launched well ahead of the Galaxy S4.
The Honami is also an interesting proposition, at least according to this new set of rumors. The device is supposed to be a ?One Sony? model, where ?One Sony? stands for all the best tech Sony would have to offer.
The Honami would pack a 5-inch 1080p display, ?dedicated Walkman audio chip? and a 16- or 20-megapixel CyberShot CMOS sensor with Carl Zeiss optics (Xenon flash and dual LED are also mentioned0. Even more interestingly, the Honami could pack a 2.3GHz quad-core Qualcomm Snapdragon 800 processor, Adreno 330 graphics, 2GB of RAM and 2700 to 3000mAh battery.

This unicorn device could also pack a ?Triluminous display.? What?s that you ask? VR-Zone explains:
TRILUMINOS is Sony?s exclusive new technology that allows for far greater color tones and textures to be displayed on the screen. In simple terms you could think of TRILUMINOS as simply a bigger box of color pencils to draw an image on the screen. A conventional display only has a limited box of color pencils to draw an image, whereas a TRILUMINOS display has a bigger box of color pencils with more shades of Blue, Red and Green color pencils.
As a result a TRILUMINOS display can reproduce more natural colors thanks to the expanded color gamut and display various shades of colors closer to reality than a conventional display. A TRILUMINOS display can output true, natural shades of colours ? like hard-to-reproduce reds, greens and blues. Faces look better, too, with rich, lifelike skin tones.
Like the Togari, the Honami would also be launched as early as July in China, and hit international markets later in August or September.
This collection of rumors comes via China, from a person that said on Baidu he?s a tester for Sony Xperia devices but also from local commerce site ePrice, while VR-Zone provided details on Sony?s supposed inclusion of the Triluminous display technology in future Xperia devices.
In other words, while these reports have certain elements in common, it?s too early to paint a clear picture for what the Togari and Honami, so don?t get too excited about these handsets just yet.

Chrysler revenue slumps on new model launches

DETROIT/MILAN (Reuters) - Carmaker Fiat's first-quarter profit slumped more than expected as its U.S. unit Chrysler's sales suffered from the phase-out of the Jeep Liberty pending a new model launch.

"We knew we would be limping in the quarter. I just didn't think I was going to limp that much," said Sergio Marchionne, chief executive of both Chrysler and its parent Fiat, on a conference call with analysts and reporters.

Marchionne in January warned that Chrysler's first-quarter earnings would be down from a year earlier because of the expense of product launches and the fact that the Jeep Liberty SUV was no longer being produced.

The Liberty's successor, the Jeep Cherokee, was not sold in the first quarter and will not be sold until the third quarter.

But Marchionne said that there were delays in the production launches of the Jeep Grand Cherokee and RAM heavy duty trucks, which he said are among the highest profit-makers.

Fiat, which took control of the third-largest U.S. automaker when Chrysler emerged from a government-sponsored bankruptcy four years ago, stood by its financial forecasts for 2013 despite a worsening European car market and lower revenue in the U.S. for the first quarter.

Fiat sees full-year revenue in the 88 billion euro to 92 billion euro range, trading profit between 4 billion and 4.5 billion euros, and net industrial debt of about 7 billion euros.

Analysts had expected a weak quarter for the combined group, and the results came in below consensus.

Trading profit was 618 million euros, below the 720 million euros forecast by 21 analysts published on Fiat's website. Pre-tax profit came in at 160 million euros, compared to a forecast of 300 million euros by analysts.

At Chrysler, first-quarter net income fell 65 percent to $166 million from $473 million a year earlier. Net revenue slipped 6 percent to $15.4 billion.

Net debt was 7.10 billion euros, in line with forecasts, and higher than the 6.5 billion euros at the end of 2012.

Citi Research analyst Harald Hendrikse said the quarter's results again highlight Fiat's difficult debt issue.

"With debt at current levels, the company cannot compete in this industry longer term against giants like Volkswagen AG spending 16 billion euros on capital expenditures and research and development," said Citi in a note.

NARROWING EUROPEAN LOSSES

Fiat's European losses before interest and tax narrowed to 111 million euros, from a year-ago loss of 170 million euros, despite a 10 percent drop in industry sales in the region. Marchionne said he expects Fiat to narrow its operating losses in Europe further in 2013.

Fiat outperformed a dismal European car market with the launch of the new Fiat 500L small car, the company said.

Fiat, like competitors Ford , General Motors and Peugeot , is losing money in Europe as buyers delay purchases of new cars until the economy improves. Unlike rivals, however, Fiat has decided to invest in retooling its idled factories to ramp up volumes of higher-margin cars for export rather than close plants.

The company aims to break even in Europe by 2015 or 2016.

LOOKING AHEAD

Chrysler said it will increase vehicle shipments in the second quarter by at least 13 percent from the first quarter, to 650,000 vehicles up from 574,000 in the first quarter.

Marchionne said the Jeep Grand Cherokee, now that its launch delays are over, will show strong April sales, and that the biggest boost in Grand Cherokee sales will show in the third quarter.

Marchionne said in the coming quarters Chrysler will better match up production and retail sales performance.

"Close your eyes, plug your nose and move it on from here," said Marchionne to analysts on a conference call.

COMING TO AMERICA?

Looking further out into the future, Marchionne said he hopes to merge Fiat and Chrysler into one group and he hinted strongly that the combined company will be headquartered outside of its native Italy.

Many observers expect the merged company to be headquartered where Chrysler is now, in Auburn Hills near Detroit, and to be listed on the New York Stock Exchange and in Italy.

Marchionne said the merged company would be headquartered in the geographical region that has "the adequacy of capital markets (necessary to) support our operations going forward."

Marchionne said that "Europe is becoming a less and less relevant fact in the scheme of things" as its share of the global auto market diminishes.

Italy has been a particularly weak player in a weakening region for auto sales.

"Italy in 2012 represented 10 percent of the overall sales of this (Fiat) Group," aid Marchionne. "And I think it's a stark reality for someone who has been a Fiat aficionado all his life. This is a different house. It looks at the world in a completely different way."

In abortion debate, both sides point to Philadelphia trial

PHILADELPHIA (Reuters) - The Philadelphia abortion clinic that prosecutors called a "house of horrors" is now being cited as powerful evidence by both abortion and anti-abortion rights groups.

Advocates on both sides of the issue spoke out as the murder trial of Dr Kermit Gosnell, accused of killing a patient and four infants during late-term abortions at his clinic, headed for closing arguments on Monday in Common Pleas Court in Philadelphia.

Gosnell, 72, who ran the now-shuttered Women's Medical Society Clinic in urban West Philadelphia, could face the death penalty if convicted. The case focuses on whether or not the infants were born alive and then killed.

"Abortion is not safe, it never has been, and what happened in Kermit's clinic is not that unusual," said Joe Scheidler, national director of the Pro-Life Action League.

Rev. Frank Pavone, director of the anti-abortion group Priests for Life, said the often gory trial testimony "will change the conversation ... It'll help people engage and make them realize they're not just talking about a theoretical idea."

Abortion-rights activists said Gosnell is an outlier among predominantly safe and legal abortion providers.

"Gosnell ran a criminal enterprise, not a healthcare facility, and should be punished to the fullest extent of the law," said Eric Ferrero, a spokesman for the Planned Parenthood Federation of America.

Shoddy practices revealed in the Gosnell case are proof that safe abortions should be easily accessible to women of all income levels, said Ilyse Hogue, the president of NARAL Pro-Choice America.

"This is a peek into the back-alley days, the pre-Roe v. Wade days. It's what too many women experienced when we didn't provide access to safe and clean abortion services," Hogue said, referring to the landmark Supreme Court ruling in 1973 that struck down state laws restricting abortion.

The charges against Gosnell and nine of his employees have added fresh fuel to the debate in the United States about late-term abortions.

It is legal in Pennsylvania to abort a fetus up to 24 weeks of pregnancy. It becomes murder if the infant is fully expelled from the mother alive and then killed, according to a lawyer familiar with Pennsylvania law, who declined to be named given the volatility of the case.

Gosnell is charged with first-degree murder for delivering live babies during late-term abortions and then deliberately severing their spinal cords, prosecutors said. He is also charged with third-degree murder in the death of Karnamaya Mongar, 41, of Virginia, who died after the procedure from a drug overdose, prosecutors said.

The doctor has pleaded not guilty to all charges, contending there is no evidence the babies were alive when they were expelled and that Mongar failed to disclose her full medical history, which may have triggered drug complications.

Testimony in the six-week trial before a seven-woman, five-man jury has depicted a filthy, squalid clinic serving mostly low-income women in the largely black community.

Early in the trial, anti-abortion rights groups criticized the national media for largely ignoring the case.

Day Gardner, the head of the National Black Pro-life Union in Washington, tied the media's initial avoidance of the trial to what she said was deeply ingrained racism in American society, noting that many of Gosnell's patients were poor black women and the doctor himself is black.

The national spotlight would have shown brighter if the victim had been "a blonde, blue-eyed child ... It's very obvious that passion across America is not quite the same when it comes to black children," Gardner said.

Gosnell, who has been in jail since his January 2011 arrest, is being tried along with Eileen O'Neill, a medical graduate student accused of billing patients and insurance companies as if she had been a licensed doctor. Eight other defendants have pleaded guilty to a variety of charges and are awaiting sentencing.

Decisions being taken by a government advisory board on children in care, not to allow abusive parents to meet children during supervised access visits, are sometimes ignored, according to a social worker.

There were occasions when the Children and Young Persons Advisory Board recommended that a child who was living in foster care, for example, did not meet his or her abusive parent during family access time.

However, the abusive parents still turned up for the visit leaving the child traumatised.

This was recounted by social worker Daniella Zerafa during a conference entitled The Rights of the Child in Foster Care.

Ms Zerafa, who also lectures at the University of Malta, presented the case study of a fostered child, who she referred to as Katya.

The true story highlighted shortcomings in the system such as delays in deciding whether to issue a care order to remove a child from an abusive family.

Another problem highlighted was the fact that although Maltese law technically allowed the Government to strip parents of parental rights, in cases of abuse, this was not done in practice.

As a result, children were not being allowed to be adopted and live in a stable home.

During the conference Family Minister Marie-Louise Coleiro Preca said that her Government put the rights of children at the centre of its policies. She will work to ensure that children are given a stronger voice and that children in care are freed up for adoption. She said that there were about 600 children who lived in out of home care of which some 230 were being fostered.

Nationalist Party spokesman for the Family Chris Said also spoke about the need to strengthen legislation in the best interest of children. ?

Senate passes bill to end air traffic control furloughs

WASHINGTON (Reuters) - The Senate moved quickly late on Thursday to end air traffic controller furloughs that were causing widespread airline flight delays related to last month's automatic federal spending cuts.

Without any debate, the Senate unanimously passed legislation giving the Department of Transportation flexibility to use unspent funds to cover the costs of air traffic controllers and other essential employees at the Federal Aviation Administration.

The House of Representatives, which is expected to approve the measure, could take it up on Friday, capping a feverish effort by Congress to end the flight delays that were snarling traffic at major U.S. airports and angering travelers.

Some Senate aides said the measure would also give the FAA flexibility to keep open nearly 150 "contract towers" at smaller airports that are staffed by non-FAA employees who help control takeoffs and landings.

Explicit language to keep open those towers was not included in the measure, however, according to the aides, and it was not clear how the agency would handle the matter.

"I'm delighted that the Senate has just passed a bipartisan bill to resolve a serious problem confronting the American traveling public and our economy," said Republican Senator Susan Collins of Maine, one of a handful of senators who wrote the legislation.

The bill moved with lightning speed in the Senate where legislation often bogs down for weeks or months. It was passed after a day of furious negotiations between lawmakers and the Obama administration.

The bill, if passed by the House, would close another chapter in a series of Washington battles over budget and taxes that have been waged since 2011.

The cause of the air traffic controller furloughs was the controversial "sequestration" that took effect on March 1, requiring across-the-board spending cuts among most federal agencies. With those cuts starting to bite, a public backlash prompted Congress to reconsider, and fully fund high-profile FAA operations.

Lawmakers are eager to fix the air travel problem before they head out of town for next week's congressional recess. They are concerned about deepening public resentment over the delays caused by the furloughs of controllers.

Democratic Senator Jay Rockefeller of West Virginia, who also negotiated the legislation, applauded its quick passage, but added, "It does nothing for other essential government operations and employees that also desperately need relief."

ANGRY TRAVELERS

Airline passengers have grown increasingly irritated over the past week with delays at major hubs like Chicago, New York, Los Angeles and Atlanta. Some have reported delays of several hours in takeoff times and planes being put in holding patterns in the air. Many pilots blame furloughs for landing delays.

The National Air Traffic Controllers Association said on Thursday that many of the 1,978 controller trainees were now working full shifts by themselves to help cover staffing shortages.

Airline executives had ratcheted up their complaints. "This is government not working - capital letters, exclamation point - when we're sitting here holding the traveling public hostage in the midst of sequestration," JetBlue Chief Executive Dave Barger said on a conference call on Thursday.

The FAA has said it had no alternative to furloughing controllers this week after Congress failed to come up with a budget deal that would have averted the $85 billion in across-the-board federal spending cuts between March 1 and September 30.

At the same time, the FAA has emphasized that passenger safety is not at risk. Airlines for America, the trade organization for U.S. airlines, also said on Thursday the furloughs had not created a safety issue.

While Republicans joined the effort for a quick fix, many were skeptical about whether the White House and FAA were taking advantage of flexibility they already had.

Republicans have accused the Obama administration of maximizing the disruptions to try to shift budget blame on Republicans, an allegation the administration has denied. Republicans have created a Twitter hashtag, #Obamaflightdelays, for people to complain about the delays.

House Oversight Committee Chairman Darrell Issa, a California Republican, and House Transportation Committee Chairman Bill Shuster, a Pennsylvania Republican, sent a letter on Thursday to Transportation Secretary Ray LaHood asking for internal documents discussing budget flexibilities. The Department of Transportation said it was reviewing the request.

But a congressional aide involved in the original automatic spending cut legislation that was enacted in August 2011 told Reuters the administration could not under current law shift money from outside accounts to fund the air traffic controller account.

SEQUESTRATION FALLOUT

Without the legislation, the FAA said it would have to furlough 47,000 employees for up to 11 days through September 30 in order to save $637 million that is required by the sequestration.

Of those 47,000 workers, almost 15,000 are full-time air traffic controllers or trainees.

The FAA issued an update that said more than 863 delays in the system on Wednesday were attributable to staffing reductions resulting from the furloughs.

An additional 2,132 delays were attributed to weather and other factors, the FAA said. The agency said it would work with airlines to minimize delays.

Airlines, many of which are reporting earnings this week, have pushed the government to quickly ease the flight delays caused by the furloughs.

Jeff Smisek, chairman and chief executive of United Continental Holdings Inc, said his company's network operations center was working around the clock to minimize the impact of fewer controllers.

"We are disappointed that the FAA chose this path, that maximizes customer disruptions and damage to airlines instead of choosing a less disruptive method to comply with the budget obligations," Smisek said on a conference call.

The proposal being weighed would not spare other agencies and federal programs from the across-the-board reductions.

Potential therapy for human prion disease

Apr. 3, 2013 ? Human diseases caused by misfolded proteins known as prions are some of most rare yet terrifying on the planet -- incurable with disturbing symptoms that include dementia, personality shifts, hallucinations and coordination problems. The most well-known of these is Creutzfeldt-Jakob disease, which can be described as the naturally occurring human equivalent of mad cow disease.

Now, scientists from the Florida campus of The Scripps Research Institute (TSRI) have for the first time identified a pair of drugs already approved for human use that show anti-prion activity and, for one of them, great promise in treating these universally fatal disorders.

The study, led by TSRI Professor Corinne Lasm?zas and performed in collaboration with TSRI Professor Emeritus Charles Weissmann and Director of Lead Identification Peter Hodder, was published this week online ahead of print by the journal Proceedings of the National Academy of Sciences.

The new study used an innovative high-throughput screening technique to uncover compounds that decrease the amount of the normal form of the prion protein (PrP, which becomes distorted by the disease) at the cell surface. The scientists found two compounds that reduced PrP on cell surfaces by approximately 70 percent in the screening and follow up tests.

The two compounds are already marketed as the drugs tacrolimus and astemizole. Tacrolimus is an immune suppressant widely used in organ transplantation. Tacrolimus could prove problematic as an anti-prion drug, however, because of issues including possible neurotoxicity.

However, astemizole is an antihistamine that has potential for use as an anti-prion drug. While withdrawn voluntarily from the U.S. over-the-counter market in 1999 because of rare cardiac arrhythmias when used in high doses, it has been available in generic form in more than 30 countries and has a well-established safety profile. Astemizole not only crosses the blood-brain barrier, but works effectively at a relatively low concentration.

Lasm?zas noted that astemizole appears to stimulate autophagy, the process by which cells eliminate unwanted components. "Autophagy is involved in several protein misfolding neurodegenerative diseases such as Alzheimer's, Parkinson's and Huntington's diseases," she said. "So future studies on the mode of action of astemizole may uncover potentially new therapeutic targets for prion diseases and similar disorders."

The study noted that eliminating cell surface PrP expression could also be a potentially new approach to treat Alzheimer's disease, which is characterized by the build-up of amyloid ? plaque in the brain. PrP is a cell surface receptor for A? peptides and helps mediate a number of critical deleterious processes in animal models of the disease.

The first author of the study, "Unique Drug Screening Approach for Prion Diseases Identifies Tacrolimus and Astemizole as Antiprion Agents," is Yervand Eduard Karapetyan of The Scripps Research Institute. Other authors include Gian Franco Sferrazza, Minghai Zhou, Gregory Ottenberg, Timothy Spicer, Peter Chase, Mohammad Fallahi, Peter Hodder and Charles Weissmann of The Scripps Research Institute.

Facebook unveils 'Home' for Android phones

MENLO PARK, Calif. (AP) ? With its new "Home" on Android gadgets, Facebook aims to put its social network at the center of people's mobile experiences.

If users choose to download Facebook's Home software starting on April 12, the social network will become the hub of their Android smartphones. A phone from HTC that comes pre-loaded with Home will also be available starting that day, with AT&T Inc. as the carrier.

The idea behind the software is to bring Facebook content right to the home screen, rather than requiring users to check apps. "Home" comes amid rapid growth in the number of people who access Facebook from phones and tablet computers. Of its 1.06 billion monthly users, 680 million log in to Facebook using a mobile gadget.

The service is part of Facebook's move to shift its users' focus from "apps and tasks" to people, said CEO Mark Zuckerberg during Home's unveiling at the company's Menlo Park, Calif., headquarters on Thursday.

The new product, which resides on the home screen of Android phones, is a family of apps designed to help people share things with their Facebook friends. Rather than seeing a set of apps for email, maps and other services when they first turn on their phones, users will be greeted with photos and updates from their Facebook feeds. There will be ads too, eventually.

"We think this is the best version of Facebook there is," Zuckerberg said.

Zuckerberg says users can have an experience on Android phones that they can't have on other platforms. That's because Google makes the software available on an open-source basis, allowing others to adapt it to their needs.

Recognizing that text messaging is one of the most important tasks on a mobile phone, Facebook also showed off a feature called "chat heads." This lets users communicate with their friends directly from their phone's home screen ? without opening a separate app.

The move that coincides with rapid growth among the number of users who access the social network from smartphones and tablet computers and Facebook's aim to evolve from its Web-based roots into a "mobile-first" company.

"What Facebook wants is to put itself at the front of the Android user experience for as many Facebook users as possible and make Facebook more elemental to their customers' experience," said Forrester analyst Charles Golvin.

The new Home service won't be available on Apple's iPhone and iPad devices. Apple's iOS and Mac operating systems include features that integrate Facebook's services, but Zuckerberg says doing something like Home would require a closer partnership.

Apple had no immediate comment.

The deeper mobile integration will likely help Facebook to attract more mobile advertisers. Though mobile ads were a big concern for Facebook's investors even before the company's initial public offering last May, some of the worry has subsided as the company muscles its way into the market.

Last year, Facebook began showing ads to its mobile audience by shoehorning corporate-sponsored content into users' news feeds, which also include updates from friends and brands they follow. Facebook now faces the challenge of showing people mobile ads without annoying or alienating them.

The mobile advertising market is growing quickly, thanks in large part to Facebook and Twitter, which also entered the space in 2012. Research firm eMarketer expects U.S. mobile ad spending to grow 77 percent this year to $7.29 billion, from $4.11 billion last year.

EMarketer said Wednesday that it expects Facebook Inc. to reap $965 million in U.S. mobile ad revenue in 2013. That's about 2.5 times the $391 million in 2012, the first year that Facebook started showing mobile ads. Clark Fredricksen, vice president at eMarketer, says "there are some clear reasons why a deeper integration with mobile operating systems and handsets make sense for Facebook. At the end of the day, the more deeply Facebook can engage consumers, no matter what device or operating system or handset," the better.

Facebook's stock rose 82 cents, or 3.1 percent, to close at $27.07 following the announcement. It's still 23 percent below its initial public offering price of $35.

White supremacists sought in prison chief's slaying

Investigators in the case of slain Colorado prison chief Tom Clements have begun a search for two white-supremacist prison gang members identified as persons of interest in the case.

The men, James Lohr and Thomas Guolee, are said to be part of the 211 Crew, a gang whose members also included Evan Ebel, the primary suspect in Mr. Clements?s killing. Mr. Ebel died in a shootout with police two days after the March 19 slaying.

Authorities have not elaborated on a tie between Ebel and Messrs. Lohr and Guolee, except to say they believe the three were in touch before the killing, The Denver Post reports.

But the warning issued Wednesday evening by the sheriff?s office in El Paso County, where Clements was killed, is the first indication that other members of the white supremacist group may have been involved in the slaying.

"These are a couple of names that have come up during the ongoing investigation of the Clements murder," Lt. Jeff Kramer, the public information officer for the sheriff?s office, told the Post. "Because of the circumstances where you have violent folks who are willing to execute a [Department of Corrections] official, we don't want to underestimate these guys.?

Both Lohr and Guolee are wanted on charges unrelated to Clements?s death, the sheriff?s office said, and both are believed to be armed. Kramer said one or both of the men may be headed to Nevada or Texas.

The investigators? announcement came the same day as reputed 211 gang ?shot caller? Benjamin Davis was sentenced in a Denver court to an additional 108 years in prison on a racketeering charge. Mr. Davis, who is already serving a 30-year conviction for robbery and assault, founded the white supremacist gang in 1995 at Denver County Jail after he claimed his jaw had been broken by a black inmate, the Post reports.

Meanwhile, news emerged earlier this week that Ebel had been released from prison in January as the result of a clerical error. He was supposed to spend four more years in prison for a 2006 assault on a police officer, but authorities mistakenly entered the charge as one to be served co-currently with his other sentences, rather than consecutively.

The week before the deaths of Clements and pizza deliveryman Nathan Leon ? whom Ebel is also suspected of killing ? Colorado authorities flagged his electronic monitoring bracelet for tampering. But by the time police followed up, Ebel had fled.

Two weeks after Ebel?s fatal shootout with police, Mike McLelland, district attorney for Kaufman County, Texas, and his wife were gunned down in their home. That case also has potential connections to a white-supremacist prison gang.

The group in question in that case is the Aryan Brotherhood of Texas, which the Southern Poverty Law Center has described as ?arguably the most violent white supremacist prison gang out there,? according to a Monitor story.

Early news reports floated possible connections between the killings of Clements and the McLellands, but so far no major evidence has emerged to support that idea.

The 211 gang operates exclusively in Colorado, and some have theorized that the group ordered the hit to settle scores with the prison authorities. One month before Clements?s killing, a ?core group? of the gang?s members were moved to another correctional facility, possibly to dilute their strength in the prison system, the Post reports.

Wall Street rises with health insurers, S&P nears record

NEW YORK (Reuters) - Stocks rose on Tuesday, led by the health care sector after a government decision on payment rates, while factory orders data confirmed the economy is steadily improving.

The S&P 500 closed at another record high, though it fell short of breaking above its all-time intraday high of 1,576.09. The Dow also ended at another record high.

The government dropped plans to cut payments for private Medicare Advantage insurers and instead said it would allow a 3.3 percent raise.

The news boosted shares of some health insurers, including Humana, which derives about two-thirds of its revenue from Medicare Advantage business. The stock jumped 5.5 percent to $79.11 and was among the biggest percentage gainers on the S&P 500. UnitedHealth Group gained 4.7 percent to $61.74.

"They didn't expect the result that they got. That will help with their bottom line," said Quincy Krosby, market strategist at Prudential Financial in Newark, New Jersey.

Strengthening U.S. data has helped stocks rally since the start of the year. On Tuesday, U.S. data showed February factory orders rose 3 percent, slightly above expectations. That follows a weak reading on manufacturing on Monday that sparked a pullback in stocks.

The S&P 500 is now up 10.1 percent since the start of the year.

For the day, the Dow Jones industrial average was up 89.16 points, or 0.61 percent, at 14,662.01. The Standard & Poor's 500 Index was up 8.08 points, or 0.52 percent, at 1,570.25. The Nasdaq Composite Index was up 15.69 points, or 0.48 percent, at 3,254.86.

The S&P 500 surpassed its 2007 closing high last Thursday, while the Dow first broke above its 2007 record on March 5.

Stocks pared gains late in the session, giving investors another reason to question the strength of the recent rally.

"The recent legs of this rally have lacked a bit of conviction," said Mark Luschini, chief investment strategist at Janney Montgomery Scott in Philadelphia. "What's been leading equity markets has been more defensive sectors."

Healthcare sector stocks are still seen as cheap relative to the overall market. Humana, which has a market cap of about $11.9 billion, has a forward price-to-earnings ratio of 9.4, below the S&P 500 P/E average ratio of about 16.5. UnitedHealth has a P/E ratio of 10.6 and Cigna has a P/E ratio of 9.7.

"We do think that healthcare stocks are a nice combination of dividend yields, growth and low valuations and we are very constructive on the sector," said Jim Russell, senior equity strategist for U.S. Bank Wealth Management in Cincinnati.

Other big gainers in the healthcare sector included shares of Cigna, up 2.9 percent at $64.75.

Most investors expect moves to be limited this week before Friday's U.S. monthly payrolls report.

The March jobs report could give clues on how successful the Federal Reserve has been in lowering unemployment, one of the primary headwinds for the economy.

About 200,000 jobs were created last month, according to a Reuters poll, down from 236,000 in February. The unemployment rate is expected to come in at 7.7 percent, unchanged from the previous period, the poll showed.

In an effort to bring down the unemployment rate, the Fed has maintained an accommodative monetary policy, which has also benefited stocks.

Other gainers included Hertz Global Holdings shares, up 6.8 percent to $23.41, after the company forecast strong earnings and revenue through 2015 due to increasing global demand for car rentals and benefits from its recently completed acquisition of Dollar Thrifty.

Among decliners, Delta Airlines Inc shares were off 8.1 percent at $14.94. Delta's unit revenue for March rose at a slower pace than in the prior two months.

Shares of Nasdaq OMX Group Inc plunged 12.8 percent to $27.91 after agreeing to buy a BGC Partners Inc. trading platform. BGC shares were up 48.6 percent at $5.72.

Shares of Hewlett-Packard fell 5.2 percent to $22.10 after Goldman Sachs downgraded them to "sell."

Volume was roughly 5.9 billion shares traded on the New York Stock Exchange, the Nasdaq and the NYSE MKT, below the 2012 average daily closing volume of about 6.45 billion.

Decliners outpaced advancers on the NYSE by about 15 to 14 and on the Nasdaq by about 13 to 10.

Google's next generation of Nexus 7 tablets from Asus will be Qualcomm-powered and arrive this July, according to Reuters. If its sources are to be believed, Mountain View is aiming to ship eight million units by the end of the year, showing it has a lot of confidence in the upcoming model. Other leaked info shows it to have more screen resolution, a thinner bezel and an unspecified Qualcomm CPU instead of the current model's NVIDIA Tegra 3, possibly to save power. There's no info on pricing or other specs and Google's not speaking at this point, of course -- but if it proves accurate, hopefully the two companies have learned their lesson from the current model's runaway success and will ramp production accordingly.

(AP) ? Apple apologized to Chinese consumers after government media attacked its repair policies for two weeks in a campaign that reeked of economic nationalism.

A statement Apple posted in Chinese on its website Monday said the complaints had prompted "deep reflection" and persuaded the company of the need to revamp its repair policies, boost communication with Chinese consumers and strengthen oversight of authorized resellers.

State broadcaster CCTV and the ruling Communist Party's flagship newspaper, People's Daily, had led the charge against the American company. They accused Apple Inc. of arrogance, greed and "throwing its weight around" and portrayed it as just the latest Western company to exploit the Chinese consumer.

The attacks quickly backfired, though, and were mocked by the increasingly sophisticated Chinese consumers who revere Apple and its products. State-run media also inadvertently revived complaints over shoddy service by Chinese companies.

Nonetheless, Apple responded with an apology from CEO Tim Cook.

"We've come to understand through this process that because of our poor communication, some have come to feel that Apple's attitude is arrogant and that we don't care about or value feedback from the consumer," Cook's Chinese statement said, as translated by The Associated Press. "For the concerns and misunderstandings passed on to the consumer, we express our sincere apologies."

Although Apple enjoys strong support from Chinese consumers, the vehemence of the attacks and the importance of the Chinese market appeared to have persuaded the company to appear contrite.

The People's Daily newspaper ran an editorial last Wednesday headlined "Strike down Apple's incomparable arrogance."

"Here we have the Western person's sense of superiority making mischief," the newspaper wrote. "If there's no risk in offending the Chinese consumer, and it also makes for lower overheads, then why not?"

Chinese observers accused People's Daily of gross hypocrisy and pointed out that the newspaper had maintained a stony silence when Chinese companies were implicated over food safety, pollution and other scandals. Meanwhile, CCTV was shamed when it emerged that celebrities had been recruited to blast Apple on Weibo, China's version of Twitter, in what had been billed as a grassroots campaign.

"The public responded in two ways to this incident," popular commentator Shi Shusi wrote on his Weibo account. "One group supports this criticism but quite a number of people felt that there are state monopolies which have severely violated customer's rights, but which are not being exposed."

Popular business magazine Caijing said its readers identified a long list of abusers, including state banks that lend to those with political connections while stiffing ordinary savers with low rates on deposits; a government oil company that sets gas prices and other rates as it sees fit; and state telecom providers notorious for their lack of customer service.

"If media is going to go after Apple, let's hope they spare some thought for those big Chinese communications companies and other monopolies, the ones that enrich special interests in the name of being publicly owned," Cai Tongqi, a lawyer from the eastern province of Jiangsu, wrote on Weibo.

Consumers seem unfazed by the state media's attacks on Apple.

Perusing the wares at an Apple reseller in Beijing's tony China World mall, recent college graduate Zeng Lu said she considered the controversy a sign of the Chinese consumer's growing maturity.

"It's great to see Chinese consumers standing up for their rights, but it's ridiculous for the People's Daily to get involved," Zeng said. "They should be criticizing state companies instead."

Apple's popularity flies in the face of China's ardent attempts to push its own brands and develop internationally competitive companies. The company also has resisted trends to enter joint ventures and move research and development to China. It also ignores big state media such as CCTV and People's Daily. Apple relies on Chinese factories, though, to make iPads, iPhones and other popular products.

Sales of Apple products in the region, which includes Taiwan and Hong Kong, grew 67 percent to $6.8 billion in the first three months of 2013, compared with the same period a year earlier, according to the company. Apple sold 2 million iPhone 5s during the first weekend it was available in China, in December.

The region is Apple's third largest market, accounting for 13 percent of all sales last year. More than 17,000 outlets sell its products in mainland China, a figure that includes 11 Apple stores and 400 premium resellers. In January, Cook said he expects China to replace North America as its largest source of revenue in the foreseeable future.

The attacks on Apple center on complaints over Apple's repair policies in China ? specifically its practice of only replacing faulty parts rather than providing new iPhones, as it does in other markets. Critics say that allows Apple to avoid having to extend its service warranty by another year. Until Monday, the Cupertino, California-based company had kept silent apart from issuing a statement March 23 explaining its repair policy and pledging its deep respect for the Chinese consumer.

Yet consumers and analysts say the complaints hardly justify Beijing's campaign of vilification. Such nationalist outbursts are not uncommon, although previous campaigns against foreign companies have often been tied to perceived national slights, as often befalls Japanese firms in China. Beijing accused Google of being an arm of American "information imperialism" after the company announced in March 2010 that it would cease censoring its search responses inside mainland China and instead send visitors to its uncensored search engine in Hong Kong.

Beijing is also angry over Washington's efforts to exclude Chinese high-tech firms Huawei Technologies Ltd. and ZTE Corp. from the U.S. market, amid worries over security. A spending bill signed by President Barack Obama two weeks ago includes a clause barring NASA, the National Science Foundation and the Justice and Commerce Departments from contracting with firms tied to the Chinese government.

Washington and Beijing have also sparred over more recent hacking attacks, including a forensically detailed report by cybersecurity firm Mandiant that tied Chinese hacking to a unit of the People's Liberation Army based in Shanghai.

Apple, however, may have been singled out simply because it is "the biggest open target," said Jim McGregor, senior counselor at consultancy APCO Worldwide.

"We're still seeing a lot of things wrapped up in economic nationalism," McGregor said.

Even before Monday's apology, he had predicted Apple would make a show of contrition to get its relations with the Chinese authorities back on track.

Duncan Clark, managing director of BDA China Ltd., a Beijing research firm, said the assault probably stems from a combination of factors, including the failure of Chinese companies to make breakthroughs in high-end consumer electronics.

"There's a general sense of frustration that China can't move further up the value chain," Clark said.

Cold, Wet Weather for North Texas: Latest Forecast Update

COLD, WET WEATHER NEXT 48 HOURS

Showers and thunderstorms are rumbling thru North Texas this afternoon.? The heaviest rain has been south and east of Dallas.? No severe weather as of 3pm, but a few stronger storms are possible for areas southeast of a line from Sulphur Springs to Kaufman to Corsicana this evening.? The greater severe threat is in the Hill Country and far south Texas.? Below you can see the area shaded in yellow under a Severe Thunderstorm Watch until 11pm.

STRONG UPPER LEVEL STORM BRINGS US MORE RAIN

We aren?t done with the rain yet.? Below you can see a strong upper level low spinning over Colorado.? This will dive south and track right along the Red River tomorrow and tomorrow night.? This will bring more widespread rain to the area.

COLD AIR FILTERING INTO THE AREA

Cold air is starting to invade the area.? Most areas west of I-35 have been in the colder air all afternoon with temperatures in the 50s.? To the east, temperatures were in the 70s.? But the cold air will win out and everyone will see cold temperatures tonight and tomorrow staying in the 40s and 50s tonight and all day tomorrow.

Rain coverage will be highest tomorrow and tomorrow night as the upper leve low tracks overhead.? We are not looking at much in the way of severe weather.? In fact, it will be mainly be rain with a few isolated thunderstorms.
